1.About us
These terms and conditions ("Terms") apply to all sales of goods and use of the website operated by Plumb Supply Ltd, a company registered in England and Wales (company no. 15784447) with registered office at Charter House, Norbury Street, Stockport, SK1 3SH ("Plumb Supply", "we", "us", "our"). By placing an order with us or using our website, you agree to be bound by these Terms.
2.Definitions
"Customer", "you" and "your" means the person, firm or company purchasing Goods from us. "Goods" means the products listed on our website or in any quotation, order acknowledgement or invoice. "Contract" means the contract for the sale and purchase of Goods formed in accordance with clause 3.
3.Orders and contract formation
All orders placed by you are an offer to purchase Goods subject to these Terms. A binding Contract is only formed once we issue a written order confirmation or dispatch the Goods, whichever occurs first. We reserve the right to refuse or cancel any order at our discretion, including (without limitation) where stock is unavailable, pricing or product information is incorrect, or we are unable to verify your details.
4.Price and payment
Prices are shown on the website and are inclusive of VAT unless stated otherwise. Delivery charges, where applicable, are added at checkout. Prices are subject to change without notice but the price payable will be the price confirmed in your order acknowledgement. Payment must be made in full before dispatch unless you hold an approved trade credit account, in which case our credit account terms apply.
5.Delivery
Delivery times quoted are estimates only and time of delivery is not of the essence. We will not be liable for any loss or damage caused by delays in delivery. Risk in the Goods passes to you on delivery. Title in the Goods does not pass to you until we have received payment in full.
6.Inspection and shortages
You must inspect the Goods on delivery and notify us in writing of any damage, shortage or non-conformity within 3 working days of delivery. Failure to do so will be deemed acceptance of the Goods as delivered.
7.Returns and refunds
Returns are governed by our Returns Policy, which forms part of these Terms. Goods must be returned unused, in their original packaging and accompanied by proof of purchase. Special order, bespoke or cut-to-size items are non-returnable unless faulty.
8.Warranties
All Goods are sold with the benefit of the manufacturer's warranty (where applicable). We make no additional warranty in respect of the Goods other than those implied by the Consumer Rights Act 2015 and the Sale of Goods Act 1979 (as applicable). All Goods must be installed by a suitably qualified person in accordance with the manufacturer's instructions and applicable regulations.
9.Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law. Subject to the foregoing, our total liability to you in respect of any Contract shall not exceed the price paid for the Goods. We shall not be liable for any indirect, consequential or economic loss, loss of profits, loss of business or loss of goodwill.
10.Trade accounts
Customers holding an approved trade credit account agree to pay all invoices in full by the end of the month following the date of invoice. We reserve the right to suspend or withdraw credit facilities at any time. Overdue accounts may be charged interest at 4% above the Bank of England base rate.
11.Intellectual property
All content on the Plumb Supply website, including text, images, logos and product information, is the property of Plumb Supply Ltd or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent.
12.Data protection
We process your personal data in accordance with our Privacy Policy and applicable data protection legislation including the UK GDPR and Data Protection Act 2018.
13.Force majeure
We will not be liable for any failure or delay in performing our obligations under any Contract caused by events outside our reasonable control, including (without limitation) acts of God, war, strikes, supplier failures, transport disruption, pandemics or government action.
14.Governing law and jurisdiction
These Terms and any Contract formed under them are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
